It probably took her five or ten seconds to realize what was happening (older we get, the slower the reaction time) but then what could she do? Dump scalding water on more of herself trying to move, or on anyone sitting next to her?
I, too, expect to be able to sip my tea or coffee and creamer within a minute or so. Now, I won't expect that anymore....
In general, while I abhor frivolous lawsuits, I think it's a dangerous precedent to outlaw them. Like so many things, it's a slippery slope. You have to allow the stupid wrong things, so that you don't lose the ability to do the unusual, unexpected ... but surprisingly necessary things. Or the things that the big boys don't want you to do, but need to be done.

Dare I? As a person who was sued as a means to get to an insurance company, I was pretty shaking in my boots -- I was sued for more than I had policy insurance. But I won the case 10-2.
